Wage and Hour Claims

File an Idaho Electronic Wage Claim

It will take approximately 30 minutes to file an electronic wage claim. To file a wage claim you will need the following information:
  • Your Social Security number
  • The business name, complete address including zip code and phone number of the employer
  • The dates your work started and ended with the employer.
  • The dates or pay period for which you have not been paid from this employer.
  • A record of the hours worked for the pay period in question and a copy of a pay stub if you have previously received one.
If this is a valid wage claim, the information you provide will be used to determine your wage claim amount. It is important that your information is accurate and complete for all questions asked. Any person making a false claim for wages or other compensation is guilty of a misdemeanor punishable by confinement in the county jail for a period not to exceed six months or by a fine not to exceed $1,000 or both. (Idaho Code, Section 45-612).

Important: Filing a wage claim with the department is NOT your only remedy. Instead of filing a claim with this department, you may file a civil complaint in small claims court or seek the assistance of an attorney. If you choose to file a wage claim with the department, the administrative procedures in Idaho Code, Section 45-617 will provide the exclusive remedy for resolving your wage claim. You will give up your right to file a civil complaint.

Note: Department personnel cannot provide legal advice, however they can explain Idaho labor laws and department procedures. For a referral to an employment attorney, please contact the Idaho State Bar Association at (208) 334-4500.

Warning: Your wage claim will not be processed if you exit before the Confirmation page.
